The NC Values Coalition has filed an amicus brief in Mosley v. Emerson. This case involves a young woman who underwent gender transition procedures as a minor and later suffered serious, irreversible harm. After bringing claims of medical malpractice against the providers involved, her case was dismissed—denying her the opportunity to seek justice under North Carolina law.

Our brief argues that the dismissal was improper, especially in light of recent North Carolina legislation that extends the time victims have to bring claims involving gender transition procedures. These laws recognize the unique challenges in discovering both the harm and its cause in cases involving complex, evolving medical treatments.

The brief further highlights the growing medical uncertainty and global debate surrounding these procedures—particularly for minors—and the serious, life-altering risks they can carry. Because of this uncertainty, true informed consent is often impossible, and patients may not fully understand the long-term consequences at the time of treatment.

Ultimately, our brief urges the court to allow this case to proceed so that the plaintiff has a fair opportunity to present her claims. North Carolina law was designed to ensure that individuals harmed by these procedures are not shut out of the courtroom before their case can be heard.
